Services Description

Calmshlight provides custom 3D modeling and printing services for figurines. Our services include design consultation, 3D modeling, printing, finishing, and shipping of custom-created figurines.

User Responsibilities

When using our services, you agree to:

Provide accurate and complete information for your orders. Submit original designs or designs you have the legal right to reproduce. Not request designs that infringe on copyrights, trademarks, or other intellectual property rights. Not submit designs that are offensive, harmful, or illegal. Communicate clearly about project specifications and requirements. Make timely payments for services rendered.

Intellectual Property

You retain ownership of the design concepts you provide. By submitting a design to us, you grant Calmshlight a license to create, modify, and produce the physical figurine for your order. We retain the right to display completed projects in our portfolio unless you specifically request otherwise.

Orders and Payment

All orders require approval of the 3D model design before production begins. Prices are quoted based on project specifications and may be adjusted if requirements change. Payment is required before shipping of completed figurines. We accept various payment methods as indicated during checkout.

Production Timeline

Estimated production timelines are provided in good faith but are not guaranteed. Delays may occur due to design complexity, material availability, or unforeseen circumstances. We will communicate any significant delays promptly.

Quality and Revisions

We strive for excellence in every project. One round of design revisions is included in standard pricing. Additional revisions may incur extra charges. Final approval of the 3D model is required before production.

Shipping and Delivery

Shipping costs are calculated based on destination and package size. Risk of loss or damage transfers to you upon delivery. We are not responsible for shipping delays caused by carriers.

Limitation of Liability

Calmshlight shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid for the specific order in question.

Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms of Use. Acceptable use includes:

• Ordering custom figurines for personal or commercial use (with appropriate rights)
• Providing accurate and complete information for orders
• Respecting intellectual property rights of others
• Communicating respectfully with our team
• Complying with all applicable laws and regulations

Prohibited Uses

You may not use our services to:

• Produce items for illegal purposes

• Delays in production or delivery beyond our reasonable control
• Damage to products after delivery
• Loss of profits, data, or business opportunities
• Issues arising from inaccurate information provided by you
• Design decisions made by you during the approval process

Termination

We reserve the right to refuse service or terminate orders that violate these terms or for any other reason at our discretion. Refunds for terminated orders will be handled on a case-by-case basis.

Dispute Resolution

If a dispute arises between you and Calmshlight, we encourage you to contact us first to seek a resolution through direct communication.

If we cannot resolve the dispute through direct communication, the following procedures apply:

• Mediation: Parties agree to attempt mediation through a mutually agreed mediator before pursuing litigation
• Arbitration: If mediation fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association
• Jurisdiction: Any legal action or proceeding arising from these terms shall be brought exclusively in the courts of Richland County, South Carolina, or the United States District Court for the District of South Carolina

You waive any right to a jury trial in connection with any dispute arising from these Terms of Use.

Changes to Terms

We may modify these Terms of Use at any time. Continued use of our services after changes constitutes acceptance of the modified terms. We will notify you of material changes by:

• Posting the updated terms on our website
• Updating the "Last updated" date at the top of this page
• Sending email notification for significant changes (if you have provided your email address)

Applicable Law
